A iniciativa busca dar segurança jurídica às operações de importação voltadas à pesquisa pública e eliminar dúvidas sobre a manutenção da imunidade quando as fundações de apoio atuam na gestão dos recursos e nos procedimentos de aquisição e despacho aduaneiro. De acordo com o ministério, essa incerteza gerava risco de tributação e dificultava a compra de equipamentos, softwares e insumos para atividades de pesquisa. A Fazenda também definiu que a administração financeira dos projetos pelas fundações é apenas um mecanismo operacional e não altera a natureza pública dos recursos vinculados às universidades e instituições de pesquisa. Exigências Para ter acesso ao benefício, as operações deverão seguir uma série de exigências, como a realização da importação em nome da instituição pública, a movimentação dos recursos em conta exclusiva do projeto, a incorporação imediata dos bens ao patrimônio da universidade ou instituto beneficiado e a prestação de contas sujeita à fiscalização da Receita Federal e dos órgãos de controle. Segundo o governo, a medida deve reduzir gargalos burocráticos, ampliar a capacidade de desenvolvimento científico e tecnológico do país e acelerar o reaparelhamento de universidades públicas, institutos federais e instituições públicas de pesquisa. A medida também busca reduzir os efeitos das limitações do atual sistema de desoneração das importações para pesquisa científica, hoje condicionado a uma cota administrada pelo Conselho Nacional de Desenvolvimento Científico e Tecnológico (CNPq), apontada pelo governo como insuficiente para atender toda a demanda de universidades e instituições de pesquisa. As mudanças foram definidas após discussões entre a Procuradoria-Geral da Fazenda Nacional (PGFN), a Receita Federal, a Advocacia-Geral da União (AGU) e representantes das universidades federais.
