O ministro Flávio Dino, do Supremo Tribunal Federal (STF), atendeu a um pedido do humorista Antonio Tabet para restaurar uma postagem no X sobre Nossa Senhora Aparecida, que havia sido removida por decisão do ministro André Mendonça, do Tribunal Superior Eleitoral (TSE).  O humorista veiculou uma foto de imagem religiosa com a legenda: “a família miliciana odeia tanto mulher preta, que resolveu atacar Nossa Senhora Aparecida”. Flávio Bolsonaro acionou a Justiça Eleitoral com a alegação de que o fato era “inverídico” e trazia “discurso de ódio e imputação de crime”. O pedido obteve decisão liminar no TSE para a retirada da postagem e de conteúdos semelhantes sob pena de multa diária de R$ 30 mil.  Durante a semana, surgiram informações de que grupos evangélicos ligados à campanha de Flávio Bolsonaro defendiam a destituição de Nossa Senhora Aparecida de “Padroeira do Brasil”. O candidato do PL nega. “Não há ilicitude” A defesa de Tabet alegou que a ordem de Mendonça promovia “censura”. Dino ponderou que a remoção do conteúdo dependeria de presumir como verdade que “família miliciana” estaria relacionada ao candidato Flávio Bolsonaro. Para o ministro, a ação de Mendonça foi “destituída de motivação e proporcionalidade”.  A decisão, segundo Dino, abrange também outras postagens que foram excluídas sob o mesmo fundamento que excluiu a do humorista Antonio Tabet. O candidato à Presidência pediu a remoção de mais de 1,5 mil publicações sobre o tema nas redes sociais. “Concluo que é impossível enxergar na postagem do peticionário (Tabet) o grau de certeza de ilicitude para - sem a adequada instrução processual - extrair duríssimas consequências contra a liberdade de expressão e, em última análise, contra a própria liberdade religiosa (...)” Para Dino, a cassação da decisão no TSE preserva a liberdade de expressão e a liberdade religiosa dos que defendem a manutenção da lei que transformou Nossa Senhora Aparecida em “Padroeira do Brasil”.  “Carga depreciativa” Ao aceitar o pedido da campanha de Flávio Bolsonaro e excluir a postagem de Tabet, o ministro André Mendonça, que é vice-presidente do TSE, afirmou que havia no conteúdo publicado "expressões de elevada carga crítica e depreciativa". De acordo com as informações fornecidas pela defesa de Flávio Bolsonaro ao TSE, a publicação havia superado 195 mil visualizações, 2 mil compartilhamentos e 11 mil curtidas em poucas horas. Segundo Mendonça, a mensagem ultrapassava o campo da opinião política e veiculava fato "objetivamente falso, informação fabricada ou grave descontextualização, aptos a interferir na livre formação da vontade do eleitor”.  Mendonça considerou, na análise preliminar, que os elementos apresentados no processo indicam que essa informação “não encontra suporte na realidade fática”. Liberdade de expressão A defesa de Antonio Tabet repudiou a decisão liminar de André Mendonça. “A ordem judicial de exclusão atinge uma manifestação que em momento algum citou o nome do candidato Flávio Bolsonaro”, afirmou o humorista. Os advogados do humorista apontaram que a liberdade de expressão e a crítica política, por mais ácidas ou incômodas que sejam, constituem elementos protegidos do debate democrático. Pope Leo XIV is visiting the pilgrimage town of Lourdes this weekend as part of his four-day trip to France, the first official papal state visit to the country in 18 years. After two days in Paris where he drew hundreds of thousands of worshippers, Pope Leo XIV will continue his visit to France on Sunday in the southwestern pilgrimage town of Lourdes with a private meeting with victims of clergy sexual abuse. The pope's four-day trip is the first official papal visit to France in nearly two decades.

More than half a million people are expected to attend the event in the heart of the French capital.
